Whatsapp Business Messaging

Betwext is developing a business messaging platform that will enable client businesses to send SMS and WhatsApp messages to their own customers, including appointment reminders, order updates, customer-service messages, marketing messages where permitted, and authentication codes.

With each client’s authorization, Betwext will use WhatsApp Business Platform data, including account information and message delivery and read status, to operate the messaging service, troubleshoot delivery and provide reporting to that client. Betwext will use this data only to provide, secure and support the service and will not sell it or use it for unrelated advertising.

Development notice: Betwext’s WhatsApp service is under development and is subject to completion of applicable Meta and Twilio onboarding, review, approval and technical-integration requirements. Features, availability, pricing and launch dates may change.

Planned Service

Once available, authorized Betwext clients may be able to connect their own Meta Business Portfolio and WhatsApp Business Account through Meta’s Embedded Signup process and Twilio’s WhatsApp infrastructure. Depending on the services selected, clients may be able to:

  • Register and manage WhatsApp business phone numbers.
  • Create, submit and manage message templates.
  • Send authentication, utility, service and marketing messages where permitted.
  • Receive and respond to customer-initiated messages.
  • View account, template, delivery, failure and read-status information.
  • Integrate WhatsApp messaging with approved business systems and workflows.
  • Obtain technical support and messaging-performance reporting.

Each client will remain responsible for its business identity, WhatsApp Business Account, customer relationships, message content, recipient selection, consent records and use of the service.

Client Authorization

By connecting a WhatsApp Business Account to Betwext, the client represents and warrants that:

  1. The client is the lawful owner of, or is authorized to administer, the applicable Meta Business Portfolio, WhatsApp Business Account, business name and telephone number.
  2. The person completing the connection has authority to grant Betwext and its service providers the access required to provide the service.
  3. All information submitted during onboarding is complete, current and accurate.
  4. The client will promptly remove access or notify Betwext if its authorization changes or ends.
  5. The client will not connect an account, number, brand or business asset belonging to another party without that party’s documented authorization.

Clients are solely responsible for determining whether they have the legal right and appropriate consent to contact each recipient through WhatsApp. Before initiating messages, clients must obtain and maintain any consent required by the WhatsApp Business Messaging Policy and applicable law. Consent must clearly identify the business that will send the messages and the types or categories of messages the recipient agrees to receive.

Clients must:

  • Maintain reliable records showing when, where and how consent was obtained.
  • Send only the types of messages covered by the recipient’s consent.
  • Clearly identify the business responsible for each communication.
  • Provide recipients with a reasonable way to stop or change communications.
  • Promptly honor opt-out, blocking and withdrawal-of-consent requests.
  • Provide a prompt, clear and direct path to a human agent or another appropriate support channel when automation is used.
  • Avoid sending messages to purchased, rented, scraped or improperly transferred contact lists.
  • Comply with applicable privacy, consumer-protection, telemarketing, advertising and electronic-communications laws.
  • Observe any time-of-day, frequency, age, geographic or industry-specific restrictions that apply.

A customer’s provision of a telephone number, prior purchase, website visit, or consent to receive SMS or email does not automatically establish consent to receive WhatsApp messages. Betwext may request evidence of consent and may restrict or suspend messaging when consent cannot be reasonably demonstrated.

Message Categories and Templates

WhatsApp messages may be classified as authentication, utility, service or marketing messages. The applicable category, approval requirements, delivery rules and pricing are determined by Meta and may change.

Business-initiated messages may require a Meta-approved message template. Approval of a template does not mean every use of that template is lawful, appropriate or compliant. Clients remain responsible for the actual message, recipient, timing, frequency, data inserted into the template and purpose of the communication.

Meta, WhatsApp, Twilio or Betwext may reject, pause, reclassify or disable templates, numbers, accounts or messages that violate applicable requirements or create unacceptable operational, legal, security or reputational risk.

Prohibited and Restricted Use

Clients may not use the service to:

  • Send unlawful, deceptive, fraudulent, misleading, abusive, threatening or harassing communications.
  • Impersonate another person, company, government agency or brand.
  • Send messages without required consent or after consent has been withdrawn.
  • Facilitate phishing, malware, credential theft, account takeover or unauthorized data collection.
  • Promote illegal products, services or transactions.
  • Circumvent Meta, WhatsApp, Twilio or Betwext policies, limits, reviews or enforcement actions.
  • Conceal the sender’s identity or materially misrepresent a message’s purpose.
  • Use sensitive personal information in a manner inconsistent with applicable law or the recipient’s reasonable expectations.
  • Send content prohibited or restricted by the WhatsApp Business Messaging Policy, WhatsApp Commerce Policy, Meta Platform Terms, Twilio Acceptable Use Policy, Betwext Acceptable Use Policy or applicable law.

Additional restrictions may apply to regulated industries, financial products, healthcare, age-restricted products, political communications, gambling, lending, cryptocurrency and other high-risk use cases. Availability of the platform does not constitute approval of a client’s business, industry, campaign or content.

WhatsApp Business Platform Data

With each client’s authorization, Betwext may process WhatsApp Business Platform data necessary to develop, operate, secure and support the service. Depending on the enabled functionality, this may include:

  • Meta Business Portfolio and WhatsApp Business Account identifiers.
  • Business profile, display-name and telephone-number information.
  • Authorized-user and account-configuration information.
  • Message templates, categories and approval status.
  • Message content and related metadata when required to transmit, receive, troubleshoot or support communications.
  • Recipient telephone numbers and other information supplied by the client.
  • Message timestamps and delivery, failure and read status.
  • Customer replies and conversation-routing information.
  • Technical logs, error information, security events and usage records.
  • Reporting and billing information.

Betwext will use Platform Data only to develop, provide, secure, troubleshoot, support and improve the services requested by the applicable client; meet contractual, legal and regulatory obligations; prevent fraud or abuse; and protect Betwext, its clients, service providers and users.

Betwext will not sell WhatsApp Business Platform data or use it for unrelated advertising. Betwext will not use one client’s identifiable Platform Data to market another client’s products or services.

Data Roles and Client Responsibilities

For client customer information processed solely to provide contracted messaging services, the client generally determines why and how the information is used, and Betwext processes that information on the client’s behalf and according to the client’s lawful instructions.

Betwext may independently process limited account, security, billing, support and compliance information for its own legitimate business and legal purposes, as described in the Betwext Privacy Policy and applicable agreements.

Clients are responsible for providing legally required notices to their customers and responding to customer privacy requests relating to the client’s business and communications. Betwext will provide reasonable assistance when required by the applicable agreement or law.

Service Providers and Data Sharing

To provide the WhatsApp service, Betwext may transmit or make information available to Meta Platforms, Inc., WhatsApp LLC, Twilio Inc., hosting providers, security providers and other authorized service providers or subprocessors involved in providing, protecting or supporting the service.

Information processed through WhatsApp and Twilio is also subject to their respective terms, privacy practices and platform policies. Clients authorize these disclosures when they connect and use the service. Betwext does not control Meta’s, WhatsApp’s or Twilio’s independent processing practices, platform decisions, pricing, service availability or policy enforcement.

Data Retention and Deletion

Betwext retains information only for as long as reasonably necessary to provide and secure the service, meet contractual obligations, resolve disputes, enforce agreements and satisfy applicable legal, accounting and regulatory requirements. Retention periods may vary according to the type of information, the client’s configuration and applicable law. Data may remain temporarily in encrypted backups, fraud-prevention records, security logs or records that Betwext is legally required to retain.

Authorized clients may request disconnection of their WhatsApp Business Account or deletion of eligible account data by emailing support@betwext.com or following the Betwext Data Deletion Instructions.

Requests must identify the applicable business account and may be subject to identity and authority verification. Disconnecting Betwext does not necessarily delete information separately retained by the client, Meta, WhatsApp, Twilio or another service provider. Individual WhatsApp users seeking access to, correction of or deletion of information held by a Betwext client should ordinarily contact that client directly.

Security

Betwext uses reasonable administrative, technical and organizational safeguards designed to protect information against unauthorized access, loss, alteration or disclosure.

No internet, telecommunications or data-storage system is completely secure. Betwext does not guarantee that messages will be delivered, read, retained or protected from every possible security threat. Clients are responsible for protecting credentials, limiting administrative access, configuring appropriate permissions and promptly notifying Betwext of suspected unauthorized use.

Clients must not include passwords, full payment-card information, private cryptographic keys or other unnecessarily sensitive information in WhatsApp messages.

Third-Party Services and Availability

WhatsApp functionality depends on services and infrastructure operated by Meta, WhatsApp, Twilio, telecommunications providers and other third parties. Their terms, policies, technical requirements, pricing and availability may change without Betwext’s control.

Betwext is not responsible for outages, delays, blocking, filtering, template rejection, account restrictions, message-quality limits, policy changes or other actions controlled by these third parties. Betwext does not guarantee acceptance of any business, account, display name, telephone number, template, campaign or message.

Fees and Third-Party Charges

WhatsApp messaging charges may vary by recipient location, message category, volume and rates imposed by Meta, Twilio or other providers. Betwext platform, onboarding, support, integration and other service fees may also apply.

Clients are responsible for applicable taxes, third-party charges and usage fees described in their Betwext agreement or order form. Rates and message classifications may change when third-party providers change their pricing or policies.

Suspension and Enforcement

Betwext may investigate suspected misuse and may limit, suspend or terminate access when reasonably necessary to protect customers, recipients, Betwext or its service providers; respond to fraud, abuse, security incidents or excessive complaints; comply with law or provider requirements; address unpaid charges; prevent harm to messaging networks or platform reputation; or enforce Betwext’s agreements and policies.

Meta, WhatsApp and Twilio may take independent enforcement action, including rejecting templates, limiting messaging, disabling numbers, suspending accounts or terminating access. Betwext cannot guarantee reversal of a third party’s enforcement decision.

Betwext provides technology, operational assistance and general information. Betwext is not a law firm and does not provide legal advice. Use of the service does not guarantee compliance with any law, regulation, industry standard or platform policy.

Clients are responsible for consulting qualified legal counsel regarding their messaging programs, consent language, privacy notices, recordkeeping, message content and industry-specific obligations.

WhatsApp is a trademark of WhatsApp LLC. Meta is a trademark of Meta Platforms, Inc. Twilio is a trademark of Twilio Inc. Other names and marks belong to their respective owners.

Betwext LLC is an independent business and is not Meta, WhatsApp or Twilio. References to these companies and their products describe third-party technologies with which Betwext’s planned service is intended to integrate. No sponsorship, endorsement, certification or partnership should be inferred except to the extent expressly confirmed in writing by the applicable third party.

Applicable Terms and Policies

Use of Betwext’s planned WhatsApp service will be subject to the applicable Betwext order form or service agreement and the policies below, each incorporated by reference where applicable:

If a conflict exists, mandatory law and applicable Meta, WhatsApp or Twilio platform requirements may control the affected functionality. Betwext may update this notice as the service, applicable law or third-party requirements change.
